Prior express written consent is required for all autodialed or prerecorded calls or text SMS messages made to cell phones or residential landlines for marketing purposes. If you are receiving many abandoned calls a day, you can call the annoyance department of your local phone company and ask that a Trap be placed on your line.

In extreme situations, the phone company might be willing to contact the offending telemarketer and request that your phone number be place on its "do not call" list. If the repeated calls are from a malicious individual who is harassing you rather than a telemarketer, the phone company will report the number to law enforcement as described in the beginning of this guide.

California Public Utilities Code Sometimes calls are annoying but are not serious enough to involve law enforcement as is necessary with either a Trap or Call Trace. These might include telemarketing sales calls, wrong numbers, overly aggressive bill collectors, and prank calls. There are several steps you can take to discourage such unwanted calls.

An answering machine or a voice mail service is one of the best ways to limit unwanted calls. An answering machine records messages when you are not available and can also be used to screen your calls.

Similar to an answering machine, a voice mail service or an answering service can also discourage unwanted calls. Another product on the market is an attachment to the telephone called an "inbound call blocker. This device is highly effective in preventing unwanted calls. However, you must be certain to give the code to everyone you want to talk to. Even so, you could miss important calls from unexpected sources, like emergency services. In most areas of the country, Custom Calling services are available from the local phone company which can help limit unwelcome calls.

However, before you sign up, look carefully at the services to be certain they will work in your situation and are worth the monthly fee. Also remember that many of these features only work within your local service area. Calls coming from outside the area might not be affected by these features. Consult the "Customer Guide" section of the phone book or the company's web site to find out the boundaries of your local service area.

Keep in mind, these services require a fee, either month-to-month or per-use. To avoid having to pay for call screening on an ongoing basis, consider purchasing a device that attaches to the telephone, such as the call screening devices mentioned above. With Caller ID , customers who pay a monthly fee and purchase a display device can see the number and name of the person calling before picking up the phone. To help consumers protect the privacy of their phone numbers, state public utilities regulators for example, the California Public Utilities Commission require local phone companies to offer number blocking options to their customers.

There are two blocking options to choose from. If the customer chooses Per Line Blocking called Complete Blocking in California , their phone number will automatically be blocked for each call made from that number.

I'd like to know why DirectTV makes calls to numbers that are on the do not call list and who I can speak to about getting put on the list. Since it was almost certainly a third party marketing company not DirecTV I don't think you have any chance of pinning this down. Actually I have everything confirmed. I got an account number and confirmation number from the agents who called me illegally and confirmed it with the DirectTV agent I called today.

So there's no doubt they had an agent call me. I have logs of the phone numbers and the credit card transactions and a legal recording of the phone call. If your number is already on the Do Not Call list, for more than 30 days, then you have to submit a complaint through the Do Not Call registry www. Voluntarily providing your credit card number to them, and knowing it is for them create an account, creates an existing business relationship so does not violate Do Not Call going forward.

There are no damages to be liable for here, as though they called you, in then you willingly provided payment info. So in the future if you get a call from a company that you do not have an existing business relationship with, decline their offer while requesting to be taken off their calling list, and submit a complaint to the Do Not Call registry if you wish to take it further.

But absolutely do not give payment info as all that says, by any reasonable perspective, is that you wanted the service. Being on the Do Not Call list and getting a telemarketer call warrants submitting a complaint to the Do Not Call registry. However there are no damages to be liable for, the same for any unwanted call, misdialed number, etc.

You want to be paid, ahem, "damages" for receiving a phone call? That is an interesting level of greed. Not worth it, especially when you willingly order service and made up front payment regardless of canceling order later.

Well have fun with that I guess. Personally I would just request to be removed from their calling list in the even such a call is received, in case it was just a one-time error, or follow-up with a complaint through the Do Not Call registry if ongoing problem. Good luck even explaining this one. One call can be ignored, 2 or 3 calls a week can NOT! They try to sell you premium channels, upgraded packages,etc. If I wanted those upgrades I would call them. Would you like me to call you every other day for services you are not interested in Call Directv and opt your account from promotional calls. As I recall can take up to 30 days if your number was in a recent national promotion of theirs or to update calling lists with 3rd party partners.

Whether you have Directv or not I do suggest the Do Not Call registry as it will assist in greatly reducing telemarketers. I hope you were smarter then the prior poster who voluntarily gave them his credit card info to them in an attempt to cry "damages" for willingly ordering and paying for service.
